Terms of service
Effective date: August 9, 2026
These Terms of Service govern the use of the INTELLECT Light online store available at www.intellect-light.com, including the placement of orders, conclusion of sales contracts, payments, delivery, customer accounts and related digital services.
1. Seller information

2. Definitions
For the purposes of these Terms:
Customer means any natural person, legal person or organizational entity placing or intending to place an order through the Store.
Consumer means a natural person entering into a contract for purposes outside their trade, business, craft or profession.
Entrepreneur with consumer rights means a natural person entering into a contract directly related to their business activity where the contract is not of a professional nature for that person, in accordance with applicable Polish law.
Seller means TRADING HOUSE INTELLECT Sp. z o.o., operating the Store under the INTELLECT Light brand.
Store means the INTELLECT Light online store operated at www.intellect-light.com.
Product means a physical product offered for sale through the Store, including a product containing or connected with digital elements.
Digital elements means software, applications, firmware, online functionality or related digital services necessary for or connected with the operation of a Product, including the INTELLECT LED application.
Sales Contract means a distance sales contract concluded between the Customer and the Seller through the Store.
Order means the Customer’s declaration submitted through the Store expressing the intention to purchase selected Products.
Terms means these Terms of Service.
3. Scope and acceptance of the Terms
These Terms apply to:

use of the INTELLECT Light Store;
-
creation and use of customer accounts;
-
placement and processing of Orders;
-
conclusion and performance of Sales Contracts;
-
payments;
-
delivery;
-
Products with digital elements;
-
complaints and statutory conformity rights;
-
electronic services provided through the Store.
The Terms are available free of charge on the Store website in a form that allows them to be viewed, saved and reproduced.
Before submitting an Order, the Customer must accept these Terms and confirm that they have read the applicable Privacy Policy and Return and Refund Policy.
Acceptance of the Privacy Policy does not constitute consent to marketing or non-essential cookies. Any consent required for those purposes is collected separately.
4. Age requirement
The Store is intended only for persons who are at least 18 years old and have full legal capacity to enter into a binding contract.
By placing an Order, the Customer confirms that they are at least 18 years old and legally capable of entering into the Sales Contract.
The Seller may cancel an Order where there are reasonable grounds to believe that the Customer does not meet this requirement, subject to applicable law.
5. Technical requirements
To use the Store and place an Order, the Customer requires:

a device with Internet access;
-
a current web browser;
-
an active email address;
-
JavaScript and cookies necessary for essential Store functionality;
-
access to a supported payment method.
Certain functions may require a customer account or an email verification code.
The Customer must not:
-
provide unlawful content;
-
interfere with the operation or security of the Store;
-
attempt unauthorized access to the Store or other customer accounts;
-
use automated tools in a way that disrupts the Store;
-
use the Store for fraudulent or unlawful purposes.
6. Products and product information
The Seller provides information about the essential characteristics of each INTELLECT Light Product on the relevant product page.
Product photographs and visualizations are intended to present the Product as accurately as reasonably possible. Minor differences in colour may result from screen settings, lighting or production characteristics and do not necessarily constitute a lack of conformity.
Before placing an Order, the Customer should review:

Product description;
-
dimensions;
-
power requirements;
-
included accessories;
-
compatibility requirements;
-
intended use;
-
available delivery methods;
-
price and applicable taxes.
Products must be used in accordance with their instructions, intended purpose and applicable safety information.
Products intended for indoor or covered outdoor use must not be exposed to conditions exceeding the protection level specified on the product page or in the instructions.
7. Products with digital elements
Certain INTELLECT Light Products can be controlled using the free INTELLECT LED application.
Use of the application requires:
-
a compatible smartphone or other supported device;
-
an Internet connection for certain functions;
-
creation of an application account;
-
acceptance of the terms and privacy information applicable to the application;
-
a 2.4 GHz Wi-Fi network for functions requiring Wi-Fi connectivity;
-
installation of necessary software, firmware or security updates.
The Product may retain basic functionality available through physical controls or a remote control, depending on the relevant Product model and specification.
The Seller will inform Customers about and provide updates, including security updates, necessary to keep Products with digital elements in conformity for the period required by applicable law.
The Customer should install necessary updates within a reasonable time after being informed that they are available.
The Seller will not be liable for a lack of conformity resulting solely from the Customer’s failure to install an update where:

the Customer was informed about the availability of the update;
-
the Customer was informed about the consequences of failing to install it;
-
the failure to install or incorrect installation was not caused by inadequate installation instructions provided by the Seller.
The availability of optional new functions that were not included in the Sales Contract is not guaranteed unless expressly stated otherwise.
Nothing in this section limits the Customer’s mandatory statutory rights concerning goods with digital elements.
8. Prices and currencies
Product prices are displayed in euros (EUR) or Polish zloty (PLN), depending on the selected Store market, country and currency settings.
The final price displayed during checkout includes applicable VAT unless expressly indicated otherwise.
The VAT rate may depend on the Customer’s delivery country in accordance with applicable European Union VAT rules.
Delivery costs and any other mandatory charges are displayed before the Customer submits the Order.
If the Customer’s bank account or payment card uses a different currency, the payment provider or bank may apply its own exchange rate or foreign-exchange fee. The Seller does not control these charges.
Where a price reduction is announced, the Store will provide the information required by applicable law, including the lowest price applied during the legally required period before the reduction where applicable.
An obvious pricing, technical or description error does not bind the Seller where the Customer knew or could reasonably have recognized that an error had occurred.
If such an error affects an Order, the Seller will contact the Customer and offer the option of confirming the Order at the correct price or cancelling it with a full refund.
9. Promotions and discount codes
Discount codes and promotional offers:
-
apply only during their stated validity period;
-
may be subject to individual conditions;
-
cannot normally be exchanged for cash;
-
may be limited to selected Products, markets or Customers;
-
may not be combined unless expressly stated otherwise.
The Seller may refuse or cancel the use of a discount code obtained or used fraudulently.
Promotional and discounted Products retain the same mandatory consumer rights as regularly priced Products.
10. Placing an Order
Orders may be placed through the Store 24 hours a day, subject to technical interruptions.
To place an Order, the Customer must:

select the relevant Product and available options;
-
add the Product to the cart;
-
provide accurate billing, contact and delivery information;
-
select an available delivery method;
-
select an available payment method;
-
review the Order summary and total price;
-
accept these Terms;
-
use the button clearly indicating that the Order involves an obligation to pay.
The Customer is responsible for ensuring that the information provided is complete and accurate.
Submitting the Order constitutes an offer by the Customer to conclude a Sales Contract.
After the Order is submitted, the Seller sends an electronic acknowledgement confirming receipt of the Order. An acknowledgement that only confirms receipt does not necessarily constitute acceptance where it expressly states otherwise.
The Sales Contract is concluded when the Seller sends confirmation that the Order has been accepted for processing, unless the checkout confirmation clearly states that the contract was concluded immediately upon submission.
The Customer receives confirmation of the Sales Contract and the applicable contractual information by email or another durable medium.
The Seller may refuse or cancel an Order for legitimate reasons, including:

Product unavailability;
-
inability to authorize payment;
-
an obvious pricing or technical error;
-
suspected fraud or abuse;
-
delivery being unavailable to the selected address;
-
violation of these Terms.
If payment has already been collected for an Order that is not accepted or is cancelled by the Seller, the payment will be refunded without undue delay.
11. Customer accounts
The Customer may be able or required to create or access a customer account.
The Customer is responsible for:
-
providing accurate account information;
-
maintaining access to their email account;
-
protecting verification codes;
-
promptly informing the Seller about suspected unauthorized access.
The Seller may suspend or close an account where:
-
the Customer requests its deletion;
-
the account is used unlawfully or fraudulently;
-
the Customer materially violates these Terms;
-
suspension is necessary to protect the Store or other users.
Account suspension does not affect rights and obligations arising from Orders already placed.
Personal data connected with customer accounts is processed in accordance with the Privacy Policy.
12. Payment methods
The available payment methods may include:
-
Shopify Payments;
-
PayPal;
-
Przelewy24.
Available methods may vary depending on the Customer’s country, currency, device or Order.
Cash on delivery is not currently available.
Payment is due when the Order is placed unless the checkout expressly provides otherwise.
Payment providers may require additional verification or apply their own terms and privacy policies.
The Seller does not receive or store complete payment card details where those details are processed directly by the payment provider.
An Order may not be processed until payment has been successfully authorized or confirmed.
13. Preparation and dispatch
Orders are normally prepared for dispatch within 48 hours after acceptance and successful payment, unless:

another period is stated on the product page;
-
the Product is temporarily unavailable;
-
the Order is placed during a period of unusually high demand;
-
the Order requires additional verification;
-
an event beyond the Seller’s reasonable control causes a delay.
The preparation period and carrier transit period are separate.
The Seller will notify the Customer without undue delay if a significant delay is expected.
The stated preparation and delivery periods do not affect any mandatory statutory delivery deadline.
14. Delivery
Delivery is available to addresses in European Union Member States supported by the Store checkout.
Delivery may be provided through:

InPost;
-
InPost courier;
-
another carrier displayed during checkout.
Available delivery methods, estimated delivery times and costs depend on:
-
delivery country;
-
delivery address;
-
Product dimensions and weight;
-
selected shipping method.
Certain oversized Products may only be available for courier delivery.
The available delivery methods and final delivery cost are shown before the Customer submits the Order.
The Customer must provide a complete and accurate delivery address and contact information.
If delivery cannot be completed because of incorrect information provided by the Customer or because the Customer fails to collect the parcel, the Seller may charge the reasonable direct cost of another delivery where permitted by law.
15. Transfer of risk
For a Consumer, the risk of accidental loss or damage passes to the Consumer when the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the Product.
If the Consumer independently appoints a carrier that was not offered by the Seller, risk may pass when the Product is handed over to that carrier, as provided by applicable law.
Damage occurring before the transfer of risk remains the Seller’s responsibility.
16. Inspection after delivery
Customers are encouraged to inspect the parcel and Product after delivery and inform the Seller about visible damage, missing components or an incorrect Product.
Failure to report an issue immediately does not remove or limit the Customer’s mandatory statutory rights.
Where reasonably possible, photographs of the parcel and Product may help the Seller process a complaint more quickly, but photographs are not an absolute condition for submitting a complaint.
17. Right of withdrawal
A Consumer or Entrepreneur with consumer rights may withdraw from a distance Sales Contract within 14 days without giving a reason, subject to statutory exceptions.
For a contract involving one Product, the period normally begins on the day the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.
For an Order containing multiple Products delivered separately, the period normally begins on the day the last Product, batch or part is received.
The Customer may exercise the right of withdrawal:

by email at hello@intellect-light.com;
-
through the electronic withdrawal function available through the Store, customer account or Order status page;
-
by sending another clear statement communicating the decision to withdraw;
-
by using the model withdrawal form available in the Return and Refund Policy.
Use of the model form is not mandatory.
The Seller will provide electronic confirmation after a withdrawal is submitted through the online withdrawal function.
Detailed information concerning:

the withdrawal procedure;

return address;
-
return shipping costs;
-
condition of returned Products;
-
refunds;
-
statutory exceptions;
-
the model withdrawal form
is available in the Store’s Return and Refund Policy.
The Return and Refund Policy forms part of these Terms.
18. Effects of withdrawal
After notifying the Seller of withdrawal, the Customer must return the Product without undue delay and no later than 14 days after communicating the decision to withdraw.

For a withdrawal unrelated to a defect or Seller error, the Customer bears the direct return shipping cost, provided the Customer was properly informed about that cost.
The Customer may inspect and test the Product only to the extent necessary to establish its nature, characteristics and functioning, as would normally be permitted in a physical store.
The Customer is responsible for any reduction in value resulting from handling beyond what is necessary for that purpose.
The absence of original packaging does not automatically remove the right of withdrawal. The Customer must nevertheless package the Product appropriately to prevent damage in transit.
The Seller will refund all payments received under the withdrawn contract, including the original delivery cost up to the amount of the least expensive standard delivery method offered for the Order.
The refund will be made without undue delay and no later than 14 days after the Seller receives the withdrawal statement.
The Seller may withhold the refund until:
-
the returned Product is received; or
-
the Customer provides evidence that the Product was sent back,
whichever occurs first.
The refund will be issued using the same payment method used for the original transaction unless the Customer expressly agrees to another method that does not create additional costs.
19. Exceptions to the right of withdrawal
The right of withdrawal does not apply where an exception provided by applicable law applies, including, where relevant, to:
-
Products made to the Customer’s specifications or clearly personalized;
-
Products liable to deteriorate or expire rapidly;
-
sealed Products not suitable for return for health protection or hygiene reasons after being unsealed;
-
sealed audio or video recordings or computer software after being unsealed;
-
digital content not supplied on a physical medium where performance began with the Consumer’s prior express consent and acknowledgement that the right of withdrawal would be lost.
Selecting a standard Product model, size or colour does not by itself make a Product personalized.
These exceptions do not limit the Customer’s rights if a Product is damaged, defective, incorrect or otherwise does not conform to the Sales Contract.
20. Conformity of Products with the contract
The Seller is required to deliver Products that conform to the Sales Contract.
A Product conforms to the Sales Contract when, subject to applicable law, it:

corresponds to its description, type, quantity and quality;
-
has the functionality, compatibility, interoperability and other characteristics agreed in the Sales Contract;
-
is suitable for the specific purpose communicated by the Customer and accepted by the Seller;
-
is supplied with the accessories and instructions agreed in the Sales Contract;
-
is suitable for purposes for which Products of the same type are normally used;
-
has the durability, functionality, compatibility, security and other qualities that a Consumer may reasonably expect;
-
corresponds to samples, models and public statements applicable to the Product;
-
is supplied with packaging and accessories that the Consumer may reasonably expect;
-
includes required updates for its digital elements.
The Seller is liable for a lack of conformity existing at the time of delivery and revealed within the period provided by mandatory law, generally two years from delivery for consumer sales under Polish law.
Applicable statutory presumptions concerning the time at which the lack of conformity existed remain unaffected.
These statutory rights are separate from any voluntary commercial warranty. Unless expressly provided, these Terms do not create an additional commercial warranty.
21. Repair and replacement
If a Product does not conform to the Sales Contract, the Consumer may request repair or replacement, subject to applicable law.
The Seller may choose the other remedy if the remedy selected by the Consumer:

is impossible; or
-
would impose disproportionate costs on the Seller compared with the alternative remedy.
If both repair and replacement are impossible or would impose disproportionate costs, the Seller may refuse to bring the Product into conformity, subject to the Consumer’s further statutory remedies.
Repair or replacement will be carried out:
-
free of charge;
-
within a reasonable time;
-
without significant inconvenience to the Consumer;
-
taking account of the nature and intended purpose of the Product.
The Seller bears the necessary costs of repair or replacement, including postage, transport, labour and materials.
The Consumer must make the Product available to the Seller. The Seller will collect the Product at its own expense where required by law.
22. Price reduction and termination for non-conformity
Subject to applicable law, the Consumer may request an appropriate price reduction or terminate the Sales Contract where, in particular:
-
the Seller refused to repair or replace the Product;
-
the Seller did not repair or replace the Product in accordance with legal requirements;
-
the lack of conformity continues despite an attempted repair or replacement;
-
the lack of conformity is sufficiently serious to justify an immediate price reduction or termination;
-
it is clear that the Seller will not bring the Product into conformity within a reasonable time or without significant inconvenience.
The reduced price must be proportionate to the decrease in the Product’s value caused by the lack of conformity.
The Consumer may not terminate the contract if the lack of conformity is insignificant, subject to the applicable burden-of-proof rules.
Where only some Products in an Order are non-conforming, termination normally applies only to those Products unless it would be unreasonable to require the Consumer to retain the remaining Products.
Amounts due following a valid price reduction or termination will be refunded within the period required by applicable law.
23. Complaints
Complaints may be submitted:

through another complaint channel made available by the Store.
A complaint should preferably include:
-
Customer’s name and contact information;
-
Order number or other proof of purchase;
-
description of the issue;
-
date on which the issue was noticed;
-
requested remedy;
-
photographs or video, where reasonably helpful.
These details are recommended to help process the complaint but are not absolute conditions for its validity.
A receipt is not the only acceptable proof of purchase.
The Seller will respond to a Consumer’s complaint within 14 days after receiving it, as required by applicable Polish law.
Failure to respond within the statutory period will have the consequences provided by applicable law.
The cost of returning a Product in connection with a justified non-conformity complaint is borne by the Seller.
24. INTELLECT LED account and digital service
The INTELLECT LED application is provided free of charge for compatible INTELLECT Light Products.
An application account is required to use app-based functionality.
The Customer must:
-
provide accurate account information;
-
protect account access credentials;
-
use the application lawfully;
-
install necessary updates;
-
comply with applicable application instructions and terms.
The application may require Internet access and a compatible device. The Customer’s Internet or mobile service provider may charge its own connection fees.
The processing of personal data through the application is governed by the privacy information applicable to the INTELLECT LED application.
Temporary interruptions may occur due to:
-
maintenance;
-
security updates;
-
technical failures;
-
circumstances beyond reasonable control.
The Seller will take reasonable steps to restore the affected functionality and comply with mandatory obligations concerning digital services and goods with digital elements.
25. Alternative dispute resolution
A Consumer may use available out-of-court complaint and dispute-resolution procedures.
Information and assistance may be available from:
-
district or municipal consumer ombudsmen in Poland;
-
the relevant Provincial Inspectorate of Trade Inspection;
-
consumer protection organizations;
-
the Polish Office of Competition and Consumer Protection at https://uokik.gov.pl/;
-
the European Consumer Centre in the Consumer’s country for eligible cross-border disputes.
Participation by the Seller in a particular voluntary ADR procedure is subject to applicable law and the Seller’s consent unless participation is mandatory.
The former European Commission Online Dispute Resolution platform is no longer available and is therefore not identified as a current complaint-submission channel.
This section does not limit the Consumer’s right to bring a claim before a competent court.
26. Personal data and cookies
Personal data is processed in accordance with the Store’s Privacy Policy.
Information about cookies, analytics, advertising pixels, Shopify Network Intelligence and Klaviyo is also provided in the Privacy Policy and the Store’s cookie settings.
The Customer can manage non-essential cookie preferences through the cookie preferences function available on the Store.
27. Liability toward business Customers
The mandatory consumer protections in these Terms apply to Consumers and, where provided by law, Entrepreneurs with consumer rights.
For other business Customers, to the maximum extent permitted by law:

the Seller’s liability for loss of profit, loss of revenue, business interruption and indirect or consequential loss is excluded;
-
the Seller’s total contractual liability is limited to the amount paid for the Product giving rise to the claim;
-
statutory warranty liability may be excluded where Polish law permits;
-
the business Customer must inspect the Product in the course of normal business practice and notify the Seller of an issue without undue delay.
These limitations do not apply where liability cannot lawfully be excluded or limited, including liability for intentional misconduct.
28. Events beyond reasonable control
The Seller is not liable for delay or failure caused by events beyond its reasonable control, including:

natural disasters;
-
war or armed conflict;
-
widespread transport disruption;
-
interruption of telecommunications or energy services;
-
actions of public authorities;
-
significant carrier disruption;
-
other force majeure events.
This provision does not remove mandatory consumer rights.
If such an event causes a substantial delay, the Seller will inform the Customer and the Customer may exercise any cancellation or refund rights available under applicable law.
29. Intellectual property
The INTELLECT Light Store and its content, including:
-
trademarks;
-
product names;
-
photographs;
-
videos;
-
text;
-
graphics;
-
software;
-
layouts;
-
designs
are protected by applicable intellectual property laws.
The Customer may use the Store and application only for lawful personal or business purchasing purposes.
No content may be copied, distributed, commercially exploited or modified without authorization, except where permitted by law.
30. Governing law and jurisdiction
These Terms and Sales Contracts are governed by Polish law.
For Consumers residing in another European Union Member State, this choice of law does not deprive them of mandatory consumer protection granted by the law of their country of habitual residence.
A Consumer may bring proceedings before a court having jurisdiction under applicable European Union and national rules.
For disputes with business Customers who are not Entrepreneurs with consumer rights, the court having jurisdiction over the Seller’s registered office will have jurisdiction, unless mandatory law provides otherwise.
31. Languages
These Terms may be made available in Polish, English and other languages used in the Store.
The Sales Contract is concluded in the language presented to and selected by the Customer during checkout.
If translations differ, the version supplied to the Customer during the ordering process will apply to that Sales Contract, without limiting mandatory consumer rights.
The Seller will make contractual information available on a durable medium in the relevant checkout language where required.
32. Changes to the Terms
The Seller may update these Terms for legitimate reasons, including:

changes in law;
-
changes in payment or delivery services;
-
changes in Store functionality;
-
introduction of new Products or digital services;
-
security requirements;
-
correction of errors.
Changes do not retroactively alter Sales Contracts concluded before the effective date of the updated Terms.
For continuing electronic services, such as customer accounts, Customers will be informed in advance about material changes where required by law.
The current version and effective date will be published in the Store.
33. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain effective.
The invalid provision will be replaced or interpreted, to the extent permitted by law, in a manner that most closely reflects its lawful purpose.
34. Final provisions
Matters not expressly covered by these Terms are governed by applicable Polish and European Union law, including mandatory consumer protection law.

These Terms of Service enter into force on August 9, 2026.
